The right of access to information and personal data protection

The right of access to information

The right of access to information is the user's right to seek and obtain information of public nature, and includes the obligation of public authorities to provide access to the requested information, i.e. to publish information regardless of the submitted request when such publication stems from an obligation defined by law or other regulation. The right of access to information is a right of all natural and legal persons to obtain information held by public authorities in the Republic of Croatia, regardless of the purpose for which the information is to be used, guaranteed by the Constitution of the Republic of Croatia and the Act on the Right of Access to Information (Official Gazette, No. 25/13, 85/15 and 69/22),

The right to access to information is exercised by proactive publishing of information on the internet, which is an obligation of public authorities pursuant to Article 10 of the Act, as well as by submitting a request for access to information to a public authority.

The Act on the Right of Access to Information grants all domestic and foreign natural and legal persons the right of access to information in the same manner and under the same conditions.

All REGOS information and documents are available on the Regos.hr website. Those information and documents that are publicly available in electronic form can be accessed directly, without submitting a special request, and all other information and documents can be accessed by submitting a verbal or a written request.

Information Commissioner

Article 35 of the Act on the Right of Access to Information (“Official Gazette”, No. 25/13, 85/15) established the institution of the Information Commissioner as an independent authority for the protection of the right of access to information.

The Information Commissioner is an independent state authority for the protection of the right of access to information that protects, monitors and promotes the right of access to information guaranteed by the Constitution of the Republic of Croatia.

Pursuant to Regulation (EU) no. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: Regulation) and the Act on the Implementation of the General Data Protection Regulation (Official Gazette, No. 42/2018, hereinafter: Act), REGOS has adopted the Personal Data Protection Guidelines.

We process personal data of data subjects legally, fairly and transparently, for specific, explicit and legitimate purposes, making sure to process those data that are necessary for the purpose of processing and taking into consideration the accuracy of these data and their storage period. We process such data in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage by applying appropriate technical or organizational measures.

Rights of data subjects, manner of exercising rights, storage period of submitted requests or complaints

The data subject exercises their rights by submitting Requests (link to Requests) in writing or personally by delivering them to the address REGOS, Gajeva 5, Zagreb, Data Protection Officer, in an envelope marked “Personal Data” or electronically to the e-mail address: zastitaosobnihpodataka@regos.hr.

The request has to contain accurate personal data of the applicant and complete, clear and accurate reasons for exercising the rights of the data subject. The data controller may request the provision of additional information from the Data Subject who submits the request, which may include data used to confirm the identity of the data subject. The data controller has the right to refuse to act on the request in the event that they are unable to determine the identity of the Data Subject and in the event when the requests are clearly unfounded or excessive, especially due to their frequency.

The data controller shall respond to the Data Subject within one month from the date of receipt of a valid request, noting that this deadline may be extended by an additional two months if necessary, taking into account the complexity and number of requests. The data controller will inform the Data Subject of any such extension within one month from the date of receipt of a valid request, while also providing reasons for delaying the response.

If the Data Subject believes that a right guaranteed by the Regulation and the Act has been violated, they have the right to file a complaint, or a request to establish whether a violation of rights took place, to the supervisory authority, Croatian Personal Data Protection Agency (AZOP), Selska cesta 136, 10000 Zagreb, e-mail: azop@azop.hr

The Data Subject is advised to contact the data protection officer to clarify disputed issues before submitting a request to establish the violation of rights to AZOP.
